GXS Bank Odyssey Terms
These Odyssey Terms (“Terms”) set out the terms and conditions that govern the relationship between GXS Bank Pte. Ltd. (the “Bank”, “us”, “we” or “our”) and the customer (“you” or “your”) and the Bank’s loyalty programme, Odyssey, that we provide to you under these Terms.
1.1 To become an Odyssey member and participate in Odyssey, you:
- must have and maintain one or more account(s) for banking services and products with the Bank (a “Bank Account”); and
- must meet such other requirements that the Bank may specify from time to time.
1.2 Your participation in Odyssey is subject to your Bank Account(s) being active and in good standing (in the Bank’s sole determination).
1.3 The Bank shall have the sole discretion to determine your eligibility to participate in Odyssey and shall be entitled to disqualify any person and/or account(s) eligible to participate in Odyssey without reason, notice or liability to any person, and shall not be liable for any Loss that may be incurred as a result.
2.1 The table below sets out the meaning of the following capitalised words when used in these Terms.
3.1 By participating in Odyssey, you will be able to participate in Mission(s) which the Bank makes available to you from time to time. Where applicable for a Mission, you will receive a specified Reward for completing the Mission.
3.2 You agree and consent to the Bank collecting, using, processing and disclosing the Personal Data provided by you through Odyssey, as well as information provided through the Bank Account(s) you maintain with us, in accordance with the Data Privacy Policy and these Terms, and for the purposes of your participation in Odyssey, including the Bank providing you with a personalised experience on Odyssey.
3.3 You agree to receive communications (including new Mission(s) and Reward(s)) from the Bank in relation to Odyssey which are notifications on the GXS app and/or emails sent to your last known email address in the Bank’s records.
3.4 You agree to receive notification(s) of each Mission and Reward through a notification on the GXS app and/or by email to your last known email address in the Bank’s records (“Mission Notifications”).
4.1 Each active Mission is available during the dates stated in the Mission or such date(s) as determined and notified by the Bank in its sole discretion (“Mission Period”).
4.2 You must successfully fulfil the requirements stated in the Mission within the applicable Mission Period, including completing the step(s) stated, to be eligible to receive the Reward specified in the Mission Notification.
4.3 Each Mission may be subject to further set of terms and conditions which shall apply in conjunction with the Terms (“Mission Terms”). By participating in each Mission, you also agree to the Mission Terms for the Mission.
4.4 Each past Mission, completed or otherwise, can be viewed via the Bank’s app.
5.1 If a Mission states that you will receive a Reward upon completion, you will receive such Reward within five (5) business days after fulfilling the requirements of, and completing, the Mission, unless otherwise stated.
5.2 Additional terms and conditions for Rewards will be set out under the Reward schedule (which may be revised from time to time without prior notice). The Reward schedule is part of these Terms. If there is any inconsistency between these Terms and the Rewards schedule, the Reward schedule will prevail to the extent of such inconsistency.
5.3 You may view all Rewards you have received in the GXS app.
5.4 The Bank shall have the absolute discretion to postpone the awarding of a Reward for a reasonable period in the event of unforeseen circumstance, including any failure or delay in the transmission of any transaction by any party
5.5 The Bank reserves the right in our absolute discretion to cancel, change, substitute or remove Rewards or make amendments to, change or substitute the conditions relating to Rewards at any time with or without prior notice to you.
5.6 All Rewards awarded and/or accumulated are not transferable and will be cancelled upon the suspension, cancellation and/or termination of the relevant Bank Account(s). Rewards cannot be transferred to or combined with Rewards awarded to any other GXS customer. In the event a Bank Account is closed for any reason and a new account of the same type is subsequently opened by you, Rewards accumulated from the closed Bank Account will not be transferred to the new account.
5.7 The Bank is not responsible or liable for any goods or services that you may purchase from an individual, a merchant or other third party provider using your Reward, or the quality of any such goods or services. We are entitled to debit from or charge to any Bank Account you maintain with the Bank, even if you do not receive the goods or services from the individual, merchant or third party provider, or the goods or services are not of satisfactory quality. If you do not receive the goods or services or the goods or services are not of satisfactory quality, you must approach the individual, merchant or other third party provider directly if you wish to seek recourse from them. Any dispute between you and the individual, merchant or other third party provider does not affect in any way your liability to us for the transaction amount, and you agree that we are entitled to debit the transaction amount in full from, or charge the same in full, to any Bank Account you maintain with the Bank, or through any other means in our discretion.
5.8 Rewards are non-negotiable, non-transferable or non-exchangeable for cash or credit. There shall be no refund or exchange for any unclaimed or unutilised Reward.
5.9 The Bank reserves the right to replace, exchange, vary or substitute any Reward with an item(s) of equivalent value at its sole discretion without prior notice or reason and without liability to any persons.
5.10 The Bank reserves the right at any time without giving any reason or notice you to claw-back, deduct, withdraw, or cancel any Reward awarded to you for instances of reversals, cancelled, void, disputed transactions or abuse of the Odyssey programme, for any other reason whatsoever, and without any compensation or liability to you.
5.11 If the Bank at any time determines at its sole and absolute discretion that any of the requirements of Odyssey or any Mission(s) were not met or complied with, including the reversal or refund of transactions, the Bank reserves the right to recover any or all Rewards (or its equivalent value) by deduction from your GXS Savings Account, any account you maintain with us, or through any other means in our discretion.
6.1 By using the GXS app, you are deemed to have read and accepted the Bank’s Terms of Use and Acceptable Use Policy which apply to your access and/or use of the GXS app.
6.2 Where permitted by the Bank, you may share, post, repost or otherwise transmit (collectively, “share”) screens, information, data, text, messages or other materials relating to Odyssey (“Materials”) via the GXS app. All Materials shared via the GXS app are your sole responsibility, and the Bank shall not be responsible for such Materials shared by you. The Bank shall not be under any obligation of confidentiality or privacy of customer information in respect of any Materials shared by you on any medium. If you share any Materials via the GXS app, you should acknowledge that the content is taken from the GXS app (or from any identified contributors as the authors of the content), and all Materials shared must not be modified in any way, and any illustrations, photographs, video or audio sequences or any graphics shall not be used separately from any accompanying text.
7.1 Your Odyssey membership is personal, non-transferable and shall be for your personal use only.
7.2 The Bank may terminate these Terms or the provision of Odyssey to you and close your Odyssey account at any time without notice or liability to any person.
7.3 If you no longer maintain at least one Bank Account with the Bank, the Bank shall automatically terminate your Odyssey membership with immediate effect and without notice to you.
7.4 Upon your cessation to be a member of Odyssey, all then outstanding Rewards at such point of time shall be automatically cancelled. Rewards should be redeemed before ceasing membership as once cancelled, you may not be able to redeem Rewards. No accumulation or carry over of Rewards will be permitted even if you subsequently reinstate your Odyssey membership.
7.5 Upon the termination of these Terms or the closure of your account with the Bank, any amount that you owe to us shall immediately become due and payable.
7.6 Termination of these Terms do not affect any rights or obligations of any party that arose before the termination, or any liabilities that accrued before the termination.
7.7 This Clause 7 (Termination) shall survive the termination of these Terms.
8.1 This Clause 8 (Grab and Singtel) shall apply to any references to Grab and/or Singtel and/or Singtel Dash within Odyssey.
8.2 The Bank is not an agent of any Grab Financial Group entity. The Bank is a separate entity from the Grab Financial Group entities. The Bank’s terms and conditions are separate from Grab’s terms and conditions. The Bank is not responsible for the terms and conditions, or any changes to the terms and conditions, of Grab.
8.3 The Bank is not an agent of any Singtel Group entity. The Bank is a separate entity from the Singtel Group entities. The Bank’s terms and conditions are separate from Singtel’s terms and conditions. The Bank is not responsible for the terms and conditions, or any changes to the terms and conditions, of Singtel.
8.4 The Bank holds a banking licence and is regulated by the Monetary Authority of Singapore. The Bank is the provider of the Bank Accounts, including but not limited to the GXS Savings Account, GXS Debit Card, GXS FlexiLoan and any services and products introduced by the Bank from time to time whether or not expressly stated herein.
9.1 The Bank may add to, amend, modify or vary any or all of these Terms (including our fees and charges) at any time without notice or liability to any person. Such addition, amendment, modification or variation will take effect on the date we specify. The Bank will notify you of any such addition, amendment, modification or variation. The Bank may introduce additional terms and conditions governing new features, services and products without giving you any advance notice.
9.2 The Bank may, at its sole discretion and without prior notice, modify, suspend or terminate the Programme, and/or modify these terms and conditions in such manner as the Bank considers fit.
9.3 The Bank’s records and decisions on all matters relating to Odyssey (including but not limited to the eligibility of any person to participate in Odyssey and the availing of any Mission or awarding of any Reward, cashback, voucher or item) shall be final, conclusive and binding on all customers. We are not obliged to entertain any correspondence.
9.4 In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to Odyssey, these Terms shall prevail.
9.5 We are not responsible or liable for the acts of any third party, including the acts of any third party involved in the provision of services or products to you, or the acts of any third party service providers, contractors or agents engaged by the Bank and their sub-contractors or the insolvency or bankruptcy of any such third party, and we will not be liable for any Loss that you may incur as a result of the acts of any such third party, unless such Loss is caused by our gross negligence, wilful misconduct or fraud.
9.6 We are not responsible for any decision you make to obtain our services and products or to enter into these Terms, and any such decision is your own decision based on your independent judgment. If you need any advice, you should seek advice from your own independent advisers.
9.7 The Bank is not responsible or liable for any Loss that you may incur as a result of us acting on any instruction that was not authorised by you or did not come from you, unless such Loss is caused by our gross negligence, wilful misconduct or fraud.
9.8 The Bank is not responsible for any failure or delay in the transmission of any transaction by any party, including acquiring merchants, merchant establishments or any telecommunication provider.
9.9 A third party who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Terms.
9.10 These Terms shall be governed by and interpreted in accordance with Singapore law. You agree to submit to the exclusive jurisdiction of the Singapore courts. You may only bring an action or proceeding against the Bank in the Singapore courts. The Bank may bring an action or proceeding against you in the courts of any jurisdiction, including any jurisdiction where you may be resident or where you may own assets.
9.11 The prevailing account terms for Bank Accounts, services and products (“Account Terms”) and any other applicable terms and conditions of the Bank (“Bank Terms”) shall apply to Odyssey. In the event of any inconsistency between these Terms and the Account Terms and/or the Bank Terms, these Terms shall, to the extent of such inconsistency, prevail in respect of matters relating to Odyssey.
Cash Reward
1. The Cash Reward for each successfully completed Mission will be credited directly into your corresponding savings account (in the Main Account or any Saving Pocket(s), as the Bank will determine from time to time in our discretion).
2. The Bank may credit Cash Rewards into your savings account after the maximum balance in your savings account has been reached.
