Credit Card Beta Launch Terms
These Beta Launch Terms set out the terms and conditions on GXS Bank Pte. Ltd. (the “Bank”, “us”, “we”, or “our”) provides the GXS Credit Card Beta Launch (“Beta Launch”) during the Beta Launch Period (as defined below).
The Beta Launch comprises the GXS Credit Card governed by the FlexiCredit Terms and GXS Credit Card Rewards governed by the Rewards Terms (collectively, “GXS Credit Card”).
By signing up for and using the GXS Credit Card during the Beta Launch Period, you confirm that you have read, understood and agree to be bound by these Beta Launch Terms as may be amended by the Bank from time to time.
If you do not or cannot agree to be bound by these Beta Launch Terms, you must not sign up for or use the GXS Credit Card during the Beta Launch Period.
These Beta Launch Terms shall apply in addition to the Bank’s terms and conditions which you accept and are bound by when you sign up for, or when using, the GXS Credit Card, including but not limited to the Bank’s FlexiCredit Terms, Rewards Terms, Data Privacy Policy and (where applicable) the Ecosystem Terms – Grab (“Bank Terms and Conditions”).
The Beta Launch period shall be the period during which a “beta” tag is indicated on the GXS Bank app, website and/or other Bank platform or publication (“Bank Platform”) in respect of the GXS Credit Card, which shall be determined by the Bank in its discretion, and shall expire when the “beta” tag ceases to be indicated on such Bank Platform (“Beta Launch Period”).
2.1 You acknowledge that, during the Beta Launch Period:
2.1.1 the GXS Credit Card is in beta and is provided “as-is” with respect to its performance, functionality, availability, use;
2.1.2 the GXS Credit Card may not operate properly, be in final form or fully functional, and any of its functions or features may contain bugs, errors, design flaws or other problems;
2.1.3 you may experience unexpected or unpredictable results, communications, delays, damage or loss when using the GXS Credit Card;
2.1.4 you assume all risks and costs associated with signing up for and using the GXS Credit Card; and
2.1.5 the Bank shall not be liable for any harm, damage, liabilities, claims or loss arising, whether direct or indirectly, in connection with your use of the GXS Credit Card or any of the services and products which the Bank provides under the FlexiCredit Terms and Rewards Terms.
2.2 You may provide feedback regarding the GXS Credit Card to the Bank at feedback@gxs.com.sg. By doing so, you agree, confirm and consent to the Bank collecting, disclosing and using your personal data for the purposes of or in connection with the Beta Launch, and to the Bank or any Bank representative contacting them via your contact information on record with the Bank, in accordance with the Bank’s Data Privacy Policy.
3.1 The Bank may add to, amend, modify or vary any or all of these Beta Launch Terms at any time without notice or liability to any person. You are deemed to accept and are bound by such variations, additions, deletions, amendments and/or modifications if you do not discontinue your use of the GXS Credit Card and terminate your banking relationship with us with respect to the GXS Credit Card in accordance with the FlexiCredit Terms. The decision of the Bank on all matters relating to these Beta Launch Terms shall be final and binding on all customers.
3.2 In the event of any inconsistency between these Beta Launch Terms and any brochure, marketing or promotional material relating to the Beta Launch, these Beta Launch Terms shall prevail.
3.3 The Bank, employees and/or independent contractors shall not be liable for any loss, liability, expense, damage and/or injury whatsoever or howsoever incurred or sustained by any person by reason of, arising from or in connection with the Beta Launch for any other reason.
3.4 These Beta Launch Terms shall be governed by and interpreted in accordance with Singapore law, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
3.5 A third party who is not a party to these Beta Launch Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Beta Launch Terms.
3.6 Unless otherwise stated, all capitalised terms used in these Terms shall have the meanings set forth in these Terms (as applicable) or as otherwise defined in the Bank Terms and Conditions.
