Ecosystem Terms - Dash
(With effect from 01 September 2023)
These Ecosystem Terms – Singtel Dash (“Terms”) set out the terms and conditions that govern the relationship between GXS Bank Pte. Ltd. (the “Bank”, “us”, “we” or “our”) and the customer (“you”or “your”) and the services and products that we provide to you under these Terms.
The Bank will make available certain services and products of the Bank on the Singtel Dash mobile application (“Dash app”) to eligible customers of Singtel Dash, by way of a platform maintained by the Bank and embedded into the Dash app (“Bank platform”).
If you are an eligible customer of Singtel Dash, you may access the Bank platform by clicking on an access point(s) for the Bank on the Dash app (“Bank access point”).
By clicking on a Bank access point, and by accessing or using the Bank platform, you are deemed to have read and agreed to these Terms and the applicable terms and conditions of the Bank, including the Bank’s Terms of Use which shall apply to your access and/or use of the Bank platform. You are advised to discontinue any access or use of the Bank platform should you disagree with the Terms of Use or any of these Terms.
This Section A (GXS Customer Journeys) sets out the terms and conditions on which the Bank provides you with customer journeys on the Bank platform, which allow you to:
(a) open a GXS Savings Account; and
(b) access and use selected GXS banking services.
1. Open a GXS Savings Account
1.1. To open a GXS Savings Account with the Bank, you must accept and agree to the GXS Bank Deposit Account Terms.
1.2. Section B (General Terms and Conditions) of these Terms apply.
2. GXS Banking Services
2.1. To access and use the Bank’s selected services and products on the Bank platform, you must:
- maintain a GXS Savings Account with the Bank;
- log in to your GXS Savings Account on the Bank platform; and
- link your GXS Savings Account to a Dash account maintained by you.
2.2. When your GXS Savings Account is linked to your Dash account, you will be able to:
- view your GXS Savings Account account number and Main Account balance;
- use funds from your GXS Savings Account to:
i. make payments with your Dash app by selecting your GXS Savings Account as the payment method;
ii. top-up and add credit to your Dash Wallet Account; - view the transactions made with your Dash app using your GXS Savings Account as a funding source;
- manage the maximum daily aggregate transaction amount using your GXS Savings Account, for making payments with your Dash app and topping-up your Dash Wallet Account; and
- use any other features or services the Bank may introduce from time to time.
2.3. Section B (General Terms and Conditions) of these Terms apply.
This Section B (General Terms and Conditions) sets out the terms and conditions that apply generally to each of Section A (GXS Customer Journeys) under these Terms.
1. Terms and Conditions
1.1. You shall comply with the Bank’s terms and conditions, including but not limited to the Terms of Use, Data Privacy Policy, Acceptable Use Policy and Deposit Account Terms.
1.2. In the event of any inconsistency between these Terms and any other terms and conditions of the Bank, such other terms and conditions shall prevail to the extent of such inconsistency.
1.3. In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to the ecosystem with Singtel Dash, these Terms shall prevail.
2. Account Opening and Eligibility
2.1. To open an account with the Bank or use a service or product of the Bank on the Bank platform, you:
- must meet such requirements that the Bank may specify from time to time, generally or in relation to any specific service or product;
- agree that the Bank may retrieve your personal information from the Myinfo platform maintained by the Singapore government; and
- agree to provide the Bank with any information or document that the Bank asks for from you in such form and manner required by the Bank from time to time.
2.2. The Bank shall have the right, in our discretion, to approve or reject any application to open any account with the Bank, or to use any service or product of the Bank, without giving any reasons and shall not be liable for any Loss that may be incurred asa result.
2.3. The Bank reserves the right to determine the eligibility of any person for the services and products that we provide to you under these Terms in our sole and absolute discretion. In addition, the Bank shall have the right to withdraw the provision of, or change the manner in which we provide you with, any service or product at any time in our discretion.
3. Instructions
3.1. Where any instruction is given through any means that require you to use a passcode or PIN to access an application or other system before giving such instruction or to provide an authentication code, you agree that the use of such passcode, PIN or authentication code is evidence that the instruction comes from you and is authorised by you.
4. Your Obligations
4.1. You represent and warrant on a continuing basis that you have the full power, authority and capacity to enter into these Terms, to enter into any transactions with or through the Bank, and to perform and comply with all your obligations under these Terms.
5. Linking your GXS Savings Account
5.1. You may at any time link or un-link your GXS Savings Account to or from your Dash account. When your GXS Savings Account is not linked to your Dash account, you will not be able to access and use the Bank’s services and products on the Bank platform.
5.2. If you link or attempt to link your GXS Savings Account with the Dash account of another person, the Bank shall have the right to un-link your GXS Savings Account from the Dash account.
5.3. The Bank may revoke your rights to link your GXS Savings Account to, and reserves the right to un-link your GXS Savings Account from, the Dash account at any time at the Bank’s discretion. The Bank reserves the right to require your prior consent before linking your GXS Savings Account to your Dash account.
6. Singtel Dash
6.1. Under these Terms, “Singtel” or “Singtel Dash” means SingCash Pte. Ltd. Singtel’s terms and conditions, including but not limited to the Terms and Conditions for Dash, as determined by Singtel from time to time apply.
6.2. The Bank is not an agent of Singtel. The Bank holds a banking licence and is regulated by the Monetary Authority of Singapore. The Bank is a separate entity from the Singtel Group entities. The Bank is the provider of the GXS Savings Account. The Bank’s terms and conditions are separate from Singtel’s terms and conditions. The Bank is not responsible for the terms and conditions, or any changes to the terms and conditions, of Singtel.
6.3. The Dash app is not operated by the Bank, and the availability and provision of the Dash app is dependent on Singtel. The Bank is not responsible for any actions of Singtel, or any non-availability of the Dash app.
6.4. Any issues or disputes relating to Singtel Dash, such as Dash Wallet Account and any rewards programme of Dash (including the fulfilment, crediting or expiry of any rewards and/or goods and/or services redeemed), should be resolved directly with Singtel. Issues relating to the Dash app, including maintenance and support issues, malfunctions, or claims relating to the Dash app, should be resolved directly with Singtel.
6.5. The Bank does not guarantee that your use and/or access to the Bank platform will remain available at all times. The Bank may change, suspend or discontinue the Bank access point(s) or the Bank platform, impose limits or conditions on certain services, or restrict your access to any part or all of the services on the Bank platform without prior notice or liability to you.
6.6. In the event of any non-availability of the Dash app or the Bank platform, please use the Bank’s mobile application to access and use the Bank’s services or products.
7. Liabilities and Indemnities
7.1. The Bank shall not be liable for any Loss that you may incur in connection with or arising from our provision of services or products to you, unless such Loss is caused by our gross negligence, wilful misconduct or fraud.
7.2. We are not responsible or liable for the acts of any third party, and we will not be liable for anyLoss that you may incur as a result of the acts of any such third party, unless such Loss is caused by our gross negligence, wilful misconduct or fraud.
7.3. You agree, on a continuing basis, to indemnify the Bank, and pay and reimburse the Bank, for all and any Losses that the Bank may incur in connection with or arising from our provision of services or products to you, except where such Loss is caused by our gross negligence, wilful misconduct or fraud.
8. Amendments
8.1. The Bank reserves the right at its absolute discretion to add to, amend, modify or vary any or all of these Terms at any time without notice including, without limitation, the eligibility of any person for GXS customer journeys under these Terms. You are deemed to accept and are bound by such variations, additions, deletions, amendments and/or modifications if you do not terminate the use of the Bank platform or terminate your participation in the GXS customer journeys under these Terms. The decision of the Bank on all matters relating to these Terms shall be final and binding on all participants. No correspondence or appeal shall be entertained by the Bank.
8.2. The Bank may introduce additional sections to these Terms that apply to the provision of new services or products without giving you any advance notice. Any such sections will take effect from the date we agree to provide you with the relevant new service or product.
9. No Third Party Rights
9.1. A third party who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Terms.
10. Governing Law and Dispute Resolution
10.1. These Terms shall be governed by and interpreted in accordance with Singapore law. You agree to submit to the exclusive jurisdiction of the Singapore courts.
11. Definitions and Interpretation
11.1. The table below sets out the meaning of the following capitalised words when used in these Terms.
“Acceptable Use Policy”
means the good practices and constraints that you must agree to comply with, for access to, and/or use of, our website at www.gxs.com.sg and/or our mobile application, as (i) set out at the following URL: www.gxs.com.sg/acceptable-use, or (ii) made available through our mobile application.
“Data Privacy Policy”
means our data privacy policy as (i) set out at the following URL: www.gxs.com.sg/data-privacy, or (ii) made available through our mobile application.
“Deposit Account Terms”
means our terms and conditions governing deposit accounts (i) set out at the following URL: www.gxs.com.sg/deposit-account-terms, or (ii) made available through our mobile application.
“Loss”
means any losses, damages, costs (including legal costs on a full indemnity basis), expenses, liabilities, taxes, charges, suits, proceedings, actions, claims, any other demands or remedies of any kind, whatsoever and however caused, whether arising under contract, tort or otherwise, and including any lost profits, earnings, business, goodwill or opportunity, whether or not foreseeable, and whether direct, indirect or consequential.
“PIN”
means the personal identification number for any service or product provided by the Bank.
“Terms of Use”
means the terms and conditions forming the basis of our agreement with you when you use and/or access any of our digital banking services and platforms, including but not limited to our website at www.gxs.com.sg and our mobile application as (i) set out at the following URL: www.gxs.com.sg/terms-of-use, or (ii) made available through our mobile application.
