Terms and conditions governing GXS FlexiCard Apply & Spend Campaign Feb - Mar 2025 (“Promotion”)
By participating in the Promotion, you agree to the following terms and conditions, as may be amended by the Bank from time to time (“Terms”). Unless otherwise stated, all capitalised terms used in this Promotion shall have the meanings set forth in the GXS Card Account Terms (Section A: General Terms and Conditions to be read together with Section C: GXS FlexiCard terms, together the “GXS FlexiCard Terms”) or as otherwise defined elsewhere in these Terms.
This Promotion is available from 4 February 2025 to 31 March 2025 (both dates inclusive) or such date(s) as may be determined by GXS Bank Pte. Ltd. (“GXS” or “Bank”) in its sole and absolute discretion (“Promotion Period”).
a. This Promotion is available to Eligible Applicants who are new-to-GXS FlexiCard customers who successfully create your virtual GXS FlexiCard during the Promotion Period.
b. Subject to Clause 2(c), You are entitled to receive S$15 cashback (“Cashback”) if you:
(i) successfully create your virtual GXS FlexiCard during the Promotion Period; and
(ii) during the applicable spend period, successfully fulfil a minimum aggregate spend of S$150 on all Qualifying Transactions on your virtual and/or physical GXS FlexiCard by the end of the next calendar month after you create your GXS FlexiCard:
(“Eligible Applicant”).
c. You will not be an Eligible Applicant if:
(i) you are an existing holder of a GXS FlexiCard account or have opened and held a GXS FlexiCard account at any time prior to the Promotion Period;
(ii) any condition in Clause 2 has not been complied with;
(iii) any information which you have provided to the Bank during the GXS FlexiCard application process has materially changed prior to your participation in this Promotion; or
(v) at any time during the Promotion Period or prior to fulfillment of the Reward:
(A) your GXS FlexiCard account with the Bank is closed, suspended, cancelled or terminated (whether voluntarily or involuntarily) or you have not paid any amount due and owing to the Bank; or
(B) you’ve breached any of the Terms of this Promotion or the GXS FlexiCard Terms.
d. “Qualifying Transaction” on your GXS FlexiCard means (i) an Eligible Transaction on your GXS FlexiCard under the GXS FlexiCard Rewards, save that no minimum spend per transaction is required for purposes of a Qualifying Transaction on your GXS FlexiCard under this Promotion, and (ii) all AXS-related payments are excluded.
e. The Cashback will be credited to your GXS FlexiCard account by 31 May 2025.
a. The Cashback is not exchangeable for cash, credit or any other items, and cannot be transferred or assigned.
b. Notwithstanding anything to the contrary in these Terms, the Cashback available on a first-come first-served basis and may be limited in quantity and the Bank makes no guarantee on the availability of a Cashback.
c. The Bank reserves the right to replace, exchange, vary or substitute the Cashback with an item(s) of equivalent value at its sole discretion without prior notice or reason and without liability to any persons.
d. If the Bank at any time determines at its sole and absolute discretion that any of the requirements of the Promotion were not met or complied with, or if Qualifying Transactions are reversed or refunded, the Bank reserves the right to recover any or all the Cashback (or its equivalent value) whether by reversing such cashback transaction or by deduction from your GXS Savings Account or any account you maintain with us (as applicable).
e. The Bank reserves the right to claw back any Cashback if it determines, at its sole and absolute discretion, that any misrepresentation, misconduct, fraud, and/or unfair or illegal conduct has been exhibited on the part of the customer at any time.
a. This Promotion is not valid with other offers or promotions unless otherwise stated. For the avoidance of doubt, all Eligible Applicants may also participate in all other GXS Bank campaigns if they have complied with the applicable terms and conditions thereunder, unless otherwise stated.
b. The Bank may add to, amend, modify or vary any or all of these Terms at any time without notice or liability to any person.
c. The Bank’s records and decisions on all matters relating to the Promotion (including but not limited to the eligibility of any person to participate in the Promotion and the awarding of any cashback, voucher or item or determination of any winner) shall be final, conclusive and binding on all customers. We are not obliged to entertain any correspondence.
d. In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to the Promotion, these Terms shall prevail.
e. The Bank, employees and/or independent contractors shall not be liable for any loss, liability, expense, damage and/or injury whatsoever or howsoever incurred or sustained by any person by reason of, arising from or in connection with the Promotion including the redemption or use of any good, service, product or facility of any merchant (if applicable) or for any other reason.
f. The Bank is not responsible for any failure or delay in the transmission of any transaction by any party, including acquiring merchants, merchant establishments or any telecommunication provider.
g. These Terms shall be governed by and interpreted in accordance with Singapore law, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
h. A third party who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Terms.
i. These Terms shall apply in conjunction with the GXS FlexiCard Terms (including any Rewards Terms) and any other relevant terms as may be updated and/or notified by the Bank from time to time.
j. The Bank reserves the right, at its sole and absolute discretion, to suspend, discontinue, extend and/or otherwise terminate the Promotion at any time without notice. The Bank shall not be liable for any damages, losses, claims or expenses arising from the suspension, discontinuance, extension and/or termination of any Promotion.
k. The Bank reserves the right to reject any application, suspend, terminate or close any GXS FlexiCard account and/or change or vary any term of the GXS FlexiCard offered (including the credit limit or any interest rate or fees/charges) at its sole and absolute discretion, including but not limited to if the Bank determines (at its sole discretion) that an Eligible Applicant has not fulfilled the terms of the Promotion and/or otherwise any misrepresentation, misconduct, fraud, and/or unfair or illegal conduct has been exhibited on the part of the Eligible Applicant at any time.
